EUROPE: COVID-19 and the European Social Charter (ESC)

The COVID-19 crisis has had a serious impact on almost all areas of life and has led to a massive curtailment of social rights in many fields. At the same time, however, the pandemic also led to a renaissance of the welfare state, which is thus gaining renewed public attention. Throughout Europe, governments took comprehensive social and labor market policy measures to cushion the devastating effects of the pandemic as best as possible and to prevent broad segments of the population from slipping into poverty and precariousness.

Persons with intellectual and psychosocial disabilities are among the most vulnerable groups of suspects in criminal proceedings. If they come into conflict with the law, they face a particularly high risk of not experiencing a fair trial. In many cases, their vulnerability due to their illness or disability is not identified in due time or not considered. Their procedural rights, particularly their right to information, their right to access a lawyer, and their right to medical assistance, in particular during deprivation of liberty, are often not adequately ensured.

The Handbook “Dignity at Trial”, which was elaborated during a two year pilot research project (2016-2018) assessing the implementation of the EC Recommendation on safeguards for vulnerable persons suspected or accused in criminal proceedings (2013/C 378/02) draws on broader involvement of professional stakeholders and persons with intellectual and/or psychosocial disabilities who have undergone criminal proceedings.

The Boltzmann Institute of Human Rights has addressed this issue, together with four European project partners, the Bulgarian Helsinki Commitee in Bulgaria, the League of Human Rights in the Czech Republik, the Organisation Mental Health Perspectives in Lithuania and the Peace Institute in Slovenia.

More and more cases have come to the fore in many economic sectors, including agriculture, construction, garments, care and cleaning work. Nevertheless, as for instance shown in the project COMP.ACT, access to effective remedies is often out of reach for trafficked persons.
