The last Turkish/Blue government used the fatal knife attack committed by an asylum seeker on the head of the social welfare office in Dornbirn as an opportunity to prominently announce preventive detention for asylum seekers. Rejection reactions from legal scholars and human rights organizations followed immediately, since preventive detention is an unlawful encroachment on fundamental rights and freedoms. Moreover, asylum seekers who pose a threat to public security can – since the 2018 amendment to the Aliens Act – already be placed in detention pending deportation during the asylum procedure. Now, the new Turkish/Green government has included exactly this preventive detention in its government program under the chapter “Asylum and Migration”.

What is the legal basis for the government’s plan? Is there a possibility that the government will succeed in introducing preventive detention? And can a constitutional amendment only apply to asylum seekers without being contrary to equality? Expert Adel-Naim Reyhani (Ludwig Boltzmann Institute for Fundamental and Human Rights) will discuss these and other questions with NEOS spokesperson for constitution and human rights Niki Scherak.
